If a man find a damsel that is a virgin, which is not betrothed, and lay hold on her, and lie with her, and they be found; 29Then the man that lay with her shall give unto the damsel’s father fifty shekels of silver, and she shall be his wife; because he hath humbled her, he may not put her away all his days.

Deuteronomy 22:28-29

The girl is a virgin and she is not engaged to be married, or betrothed. If a man “lay hold on her”, takes her by force, rape. In such cases, the man must take her as his wife.

2 Samuel 2:21 And Abner said to him, Turn thee aside to thy right hand or to thy left, and lay thee hold on one of the young men, and take thee his armour. But Asahel would not turn aside from following of him.

1 Kings 13:4 And it came to pass, when king Jeroboam heard the saying of the man of God, which had cried against the altar in Bethel, that he put forth his hand from the altar, saying, Lay hold on him. And his hand, which he put forth against him, dried up, so that he could not pull it in again to him.

For cases where it is consensual and not rape, we have Exodus 22:16-17.

Exodus 22:16-17 And if a man entice a maid that is not betrothed, and lie with her, he shall surely endow her to be his wife. 17If her father utterly refuse to give her unto him, he shall pay money according to the dowry of virgins.

The law is different for a woman who is betrothed/married. Betrothal is like marriage in all aspects except sexual intercourse.

Deuteronomy 22:23-27 If a damsel that is a virgin be betrothed unto an husband, and a man find her in the city, and lie with her; 24Then ye shall bring them both out unto the gate of that city, and ye shall stone them with stones that they die; the damsel, because she cried not, being in the city; and the man, because he hath humbled his neighbour’s wife: so thou shalt put away evil from among you. 25But if a man find a betrothed damsel in the field, and the man force her, and lie with her: then the man only that lay with her shall die: 26But unto the damsel thou shalt do nothing; there is in the damsel no sin worthy of death: for as when a man riseth against his neighbour, and slayeth him, even so is this matter: 27For he found her in the field, and the betrothed damsel cried, and there was none to save her.

This happening in a city means that there would have been some one to hear if the woman cried out. In those days every man from 20yrs up to 50yrs was in the army of Israel and would have come to her aid. Today it would be doubtful. If happening in a field she is given the benefit of the doubt as to whether anyone could have heard her.
